Everything Couples Need to Know Before, During & After the Ceremony

This guide walks you through the full legal process: from obtaining your license at the Courthouse to what happens after your officiant signs it on your wedding day.

Getting Your Marriage License at the Court Clerk's Office

Snagging your marriage license here is a breeze, but a little pre-planning goes a long way. Aim for the sweet spot: apply for your license one to two weeks before your ceremony. This gives you a nice, safe buffer without getting too close to the 60-day expiration date. If your big day is more than 60 days out, hold tight and wait until you're within that exciting 60-day countdown to apply.

What to Bring

  • Both partners must appear in person, you cannot apply separately
  • Valid government-issued photo ID: driver's license, passport, or state-issued ID
  • $30 fee, payable by cash or check to the Clerk's Office 
  • If either partner was previously married, you may need documentation of the divorce decree or the prior spouse's death

The Charlottesville Circuit Court Clerk's Office is located at 315 East High Street, Charlottesville, VA 22902.

Most couples find parking easiest along 4th Street NE, E Jefferson Street or at the Market Street Parking Garage, a short walk from the courthouse.

What Happens After You Receive Your License

Your marriage license is issued, but it isn't complete yet. After your ceremony, the license must be signed by your officiant and returned to the Clerk's Office to make your marriage legally official in Virginia. Here's what that process looks like:

  • Bring your marriage license to your ceremony venue. Your officiant will need it on the day
  • Immediately following the ceremony, your officiant signs the license as the officiating witness. Something that often surprises couples is that the official marriage license only needs to be signed by the officiant after the ceremony. A second "ceremonial keepsake" copy is often provided for the couple to sign and keep, but is non-official document.
  • Your officiant then files the completed license with the Charlottesville Circuit Court Clerk's Office
  • The Clerk's Office processes and records the marriage; you'll receive a certified copy by mail (allow 2–4 weeks)
  • If you need certified copies sooner, you can request them directly from the Clerk's Office

Don't leave the license at home! Many couples are so focused on the day that this step slips their mind. Your officiant will remind you, but it's worth double-checking the morning of your wedding.

How Many Copies of Your Marriage Certificate Should You Get?

After your marriage is recorded, you’ll have the option to request certified copies of your marriage certificate from the Clerk’s Office. While one copy may technically be enough, most couples find it helpful to order 2–3 certified copies to make post-wedding tasks easier and more efficient.

Your certified marriage certificate is what you’ll use when updating important records, including:

  • Social Security
  • Driver’s license
  • Passport
  • Bank accounts

Having multiple copies on hand allows you to handle these updates simultaneously, without waiting for a single document to be returned between agencies.

The good news is that you can apply at any circuit court in Virginia, and the license is valid statewide, so it does not have to be in the same county where your wedding will take place.

Virginia also makes the process relatively simple: there is no residency requirement, no waiting period, and once issued, your license is valid for 60 days. After your ceremony, your authorized officiant will complete and return the license to the court, and it will be officially recorded.
